These Terms constitute an electronic record in accordance with the provisions of the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital
Media Ethics Code) Rules, 2021 there under, as amended from time to time.
User means any person including any organization etc., who use/access/browse the Application/Website/Services (with or without payment/with or without subscription) through any means shall signify your acceptance of the terms, and your agreement and acknowledgement to be legally bound by the same.
iWhizz.in is the Applicaton/Website/Service that impart soft-skills to young graduates and to
provide a range of other job recruiting services to prospective job seekers and employers alike in
one place and is focused on helping the young graduates to upgrade their skills and explore more
job opportunities and help the employers to find a suitable candidate/job seeker to do a particular
job owned and managed by ILLUMINE Career Centre Private Limited.
Please carefully read the Terms & Conditions along the Privacy Policy with respect to
registration with us and before the use of the Application/Website/Services. In the event of any
discrepancy between the Terms and any other policies with respect to the Application/Website/Services, the provisions of the Terms shall prevail.
If you do not agree with the Terms & Conditions or the Privacy Policy, please do not use the Application or Website or
avail the Services. Any access to our Website/Services/Application through
registrations/subscription is nontransferable.

Except as mentioned below, all information, content, material, trademarks, services
marks, trade names, and trade secrets including but not limited to the software, text,
images, graphics, video, script and audio, contained in the Application/Website/Services
and products are proprietary property of the iWhizz ("Proprietary Information"). No
Proprietary Information may be copied, downloaded, reproduced, modified, republished,
uploaded, posted, transmitted or distributed in any way without obtaining prior written
permission from the iWhizz and nothing on this Application/Website/Services shall be
deemed to confer a license of or any other right, interest or title to or in any of the
intellectual property rights belonging to the iWhizz, to you/the user. You/The User may
own the medium on which the information, content or materials resides, but iWhizz shall
at all times retain full and complete title to the information, content or materials and all
intellectual property rights inserted by iWhizz on such medium. Certain contents on the
Website may belong to third parties. Such contents have been reproduced after taking
prior consent from said party and all rights relating to such content will remain with such
third party. Further, you recognize and acknowledge that the ownership of all trademarks,
copyright, logos, service marks and other intellectual property owned by any third party
shall continue to vest with such party and You/the user are not permitted to use the same
without the consent of the respective third party.

The Users agree and acknowledge that iWhizz is only an online platform to provide a
range of other job recruiting services to prospective job seekers and employers alike by
interviewing Candidates, Background Check, Resume Preparation and Soft Skill
Training. The Users further understand and accept that:

The Users are ultimately responsible for choosing and/or interacting with other Users on
the Site and iWhizz is only a facilitator that shall not be held responsible or liable for the
selection and/or interaction of the Users with other Users on the Site.

iWhizz may provide the Users the profile previews of other Users who may be suitable to
tender to the requirements of the Users based on information that the Users provide to
iWhizz. Please note that iWhizz

does not recommend or endorse any other User i.e it does not endorse any job seeker and employer registered on the Site; and

does not make any representations or warranties with respect to the other Users or the Jobs listed
by them. iWhizz shall not be liable, for any reason whatsoever, for any disputes amongst
the Users and there is no liability on iWhizz for the consequences that the Users may be
subjected to while dealing with other Users on the Site.

Information regarding all the Users and/or any third party whose services the Users avail
through the Site as displayed on the Site is intended for general reference purposes only.
Such information is mainly self-reported by the Users and/or the third party and may
change from time to time or become out of date or inaccurate. The Users are encouraged
to independently verify any such information the Users see on the Site with respect to the
other Users or the property listed by them.
- The Users understand and agree that any interactions and associated issues with the other
Users and/or the third parties with whom the Users interact through the Site or the third
party whose services the Users avail through the Site including but not limited to any
service-related issues, any Prohibited Conduct issue, any fraudulent activity is strictly
amongst the Users and/or the third party and the User shall not hold iWhizz responsible
for any such interactions and associated issues. If the Users decide to engage with other
Users, the Users do so at their own risk
- iWhizz cannot assure that all the transactions will be completed nor does iWhizz
guarantee the ability or intent of the Users to fulfil their obligations under any
transaction. iWhizz advises the Users to perform their own investigation prior to selecting
and/or interacting with the other Users on the Site.
- The information and offers available on the Site in relation to the Services are mere
guidelines for the purposes of providing general information on the subject and any other
information through or on the Site is not an offer and/or recommendation from/ by iWhizz.
- The Content should not be regarded as legal, financial or employment advice for the
User. iWhizz advises the User to make independent enquiries and obtain professional
advice before making financial or employment decisions. The resume, job offers
provided on the Site are provided by the user and no responsibility is taken by iWhizz for
any error, omission or misunderstanding in construing those particulars.
- The Services are chosen and used at the User’s risk and discretion and iWhizz makes no
representations or warranties, express or implied, to the User in relation to the Services or
otherwise regarding this Agreement, including the implied warranties of merchantability
and fitness for a particular purpose.
- The User understands and acknowledges that the User assumes certain risks prior to
interacting with other Users/ persons/ Third Party Service Providers on and through the
Site, and the User shall be solely responsible for such User’s personal assessment of
specific requirements with regard to interaction with other Users/ persons/ Third-Party
Service Providers.
- iWhizz expressly disclaims any liability or responsibility whatsoever and howsoever
arising as a result of any Content/ listing posted on the Site/ made available to iWhizz by
any User or any third party or any deficiency in service that is caused to the User due to a
Third-Party Service Provider.
- iWhizz does not warrant the Services or the results obtained from the use or that the
Services will meet the User’s expectations or requirements or that the Site will be
uninterrupted or free from any technical error.
- iWhizz is not responsible for the accuracy or reliability of any third-party reports, market
information, studies and analysis made available on the Site and any external web links
mentioned on the Site.
- iWhizz does not have the obligation to physically meet, conduct background or police
verification of the Users. iWhizz accepts User Information in good faith and shall not be
held responsible with regard to the bonafides of the Users.
- iWhizz shall not be liable for any damages, expenses, costs or losses incurring from the
User’s engagement in Prohibited Conduct and availing services of Third-Party Service
Providers.
- iWhizz shall not be held liable or responsible for indemnifying, refunding or reimbursing
any User for any loss, damages or expenses suffered or incurred by such User as a
consequence of the suspension or deactivation of the User’s Account.
- iWhizz shall not be liable for any third party fees, costs, charges or expenses incurred by
the User for accessing the Site or availing the Services. iWhizz shall not be liable in
respect of any disputes or legal proceedings between the User and such third party for
any reason whatsoever and any such disputes or proceedings shall be resolved outside the
Site without any reference or recourse to iWhizz
- iWhizz neither has access to, nor does the Agreement govern the use of cookies or other
tracking technologies that may be placed by Third Party Service Providers on the Site.
These parties may permit the User to opt out of tailored advertisement at any time,
however, to the extent advertising technology is integrated into the Services, the User
may still receive advertisements and related updates even if they choose to opt-out of
tailored advertising. iWhizz assumes no responsibility or liability whatsoever for the
User’s receipt or use of such tailored advertisements.
- iWhizz and its officers, directors, employees and agents collectively at all times shall be
held indemnified against any losses, costs, expenses, claims, suits and/or damages
(including reasonable attorney fees)incurred and/or suffered by iWhizz, whether directly
or indirectly, resulting from, an act or a failure to act, of any User, person or Third-Party
Service Provider for any reason whatsoever and against any claims, suits and/or legal
proceedings initiated by third parties inclusive of but not limited to the User’s:
- breach of any terms of this Agreement;
- third party claims arising from an infringement or alleged infringement of such
third party’s Intellectual Property;
- claims made by any Government Authority due to the User’s violation of
Applicable Law; or
- actual or alleged gross negligence or willful misconduct in connection with the
User’s use of the Services or this Agreement.
- a fraudulent act committed by a User which results in loss or damage, suffered or
incurred by any other User or by any third party
- The following actions will inter alia constitute a misuse of iWhizz and are strictly
prohibited:
- Utilising the Services offered by iWhizz in any manner so as to impair the interests and
functioning of iWhizz and which is non-compliant with laws and regulations including IT
Act.
- Copying, extracting, downloading, sharing, modifying, selling, storing, distributing,
making derivate works from or otherwise exploiting any content, data, information,
including profiles, personal details, photographs and/or graphics, available on iWhizz
and/or any services of the iWhizz, in any manner or for any purpose which is not,
consistent with in accordance with the Terms of Use.
- Users are expressly prohibited from using or exploiting iWhizz and/or any content or data
provided therein for any commercial purposes such as creating alternate databases,
extending access to iWhizz to third parties without prior written consent of the iWhizz;
and/or undertaking any business activity which is in competition with the business of
iWhizz; and/or sharing access with persons who are not contracted with the iWhizz.
- Reselling the services offered by the iWhizz.
- (Using or attempting to use any automated program, software or system or any similar or
equivalent process (including spiders, robots, crawlers etc.) to access, navigate, search,
copy, monitor, download, scrape, crawl or otherwise extract in any manner, any data or
content including but not limited to adding or downloading profiles, contact details, or
send or redirect messages from iWhizz;
- Gaining or attempting to gain unauthorized access (inter alia by hacking, password
“mining” or any other means) to: (a) any portion or feature of iWhizz or any of the
services or products offered on or through iWhizz which are not intended for you; (b) any
server, website, program or computer systems of the iWhizz or any other third parties
and/or Users;
- Modifying the services provided through iWhizz or their appearance using any
technology or overlay any additional offering on top of such services or simulate
iWhizz’s services or its functions in any manner whatsoever without explicit consent
obtained in writing by approach us.
- Accessing iWhizz through interfaces other than those expressly provided by iWhizz;
- Attempting to breach or breaching any security or authentication measures set up by the
iWhizz in relation to iWhizz and/or attempting to probe, scan or test the vulnerability of
the iWhizz’s system or network;
- Scraping, downloading (including bulk- downloading), replicating or otherwise
extracting any information or data from iWhizz (by any process, whether automatic or
manual) to offer any services which are similar to or may in any manner compete with
the products or services of the iWhizz;
- Reverse engineering, decompiling, disassembling, deciphering or otherwise attempting to
do any of the aforesaid or deriving the source code for the Site or Application or any
related technology or any part thereof;
- Circumventing or attempting to circumvent any technological protections used or
employed by the iWhizz or by any third party in order to protect the content on iWhizz
and/or to exclude robots, spiders etc. from crawling and /or scraping content from
iWhizz.
- Bypassing or circumventing or trying to circumvent any service limits including but not
limited to Search limits, Captcha limits and occurrences on different triggers
- Interfering with or disrupting or attempting to interfere with or disrupt (including by
using any device, software or routine), the use of iWhizz or any computer networks
connected to iWhizz, by any other User;
- Developing, using or attempting to use any automated program, scripts, robots, third
party software or system or any similar or equivalent process (including spiders, robots,
crawlers, browser plug-ins/extensions/add-ons, iframes on third party sites, mirroring,
HTML parsers etc.) to access, navigate, search, copy, monitor, download, scrape, crawl
or otherwise extract or modify in any manner, any data or content from iWhizz without
explicit consent obtained in writing by approach us.
- Impersonating any other person or entity, or making any misrepresentation as to your
employment by or affiliation with any person or entity;
- Forging headers or in any manner manipulating identifiers in order to disguise the origin
of any user information;
- Stalking, threatening, or in any manner harassing any other User;
- Imposing an unreasonable or disproportionately large load on iWhizz’ infrastructure;
- Engaging in “framing,” “mirroring,” or otherwise simulating the appearance or function
of iWhizz (or any part thereof) and providing deep links into iWhizz (or any part thereof)
without prior permission of iWhizz;
- Spamming iWhizz/iWhizz or any other Users including by uploading, posting,
emailing, SMS, transmitting or otherwise making available either directly or indirectly,
any unsolicited bulk e-mail or unsolicited commercial e-mail.
- Hosting, modifying, uploading, posting, transmitting, publishing, or distributing any
material or information that:
- Violates any applicable local, provincial, state, national or international law,
statute, ordinance, rule or regulation for the time being in force;
- Belongs to another person and to which you have no right;
- Infringes, breaches or otherwise contravenes the rights of the iWhizz or any third
party, including any copyright, trademark, patent, rights of privacy or publicity or
any other proprietary rights;
- Contains computer viruses, or other computer code, files or programs designed to
disrupt, destroy or interfere with or limit the functioning of iWhizz, or any other
computer system or resource;
- Is grossly harmful, harassing, invasive of another's privacy, hateful, disparaging,
relating to or encouraging money laundering or gambling in any manner, any
content which is or may potentially be perceived as being harmful, threatening,
abusive, harassing, defamatory, libelous, blasphemous, vulgar, pornographic,
paedophilic, obscene, or racially, ethnically, or otherwise unlawful in any manner
whatsoever;
- Which constitutes or encourages conduct that would constitute a criminal offence,
give rise to other liability, or otherwise violate applicable law;
- That deceives or misleads the addressee about the origin of such messages or
communicates any information which is grossly offensive or menacing in nature;
- That harms minors in any way;
- That threatens the unity, integrity, defense, security or sovereignty of India,
friendly relations with foreign states, or public order or causes incitement to the
commission of any cognisable offence or prevents investigation of any offence or
is insulting to any other nation.
- DISCLAIMER: THIS WEBSITE, THE APPLICATION AND THE SERVICES
ARE PROVIDED ON AN "AS IS" BASIS WITH ALL FAULTS AND WITHOUT
ANY WARRANTY OF ANY KIND. IWHIZZ HEREBY DISCLAIMS ALL
WARRANTIES AND CONDITIONS WITH REGARD TO THE WEBSITE,
APPLICATION AND THE SERVICES, INCLUDING WITHOUT LIMITATION,
ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY,
TIMELINESS, PERFORMANCE, COMPLETENESS, SUITABILITY AND NON-INFRINGEMENT. ADDITIONALLY, IWHIZZ SHALL NOT BE LIABLE FOR
ANY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR
PERFORMANCE OF THE WEBSITE, OR THE APPLICATION OR THE
SERVICES. YOUR USE OF ANY INFORMATION OR MATERIALS ON THE
WEBSITE/APPLICATION/SERVICES IS ENTIRELY AT YOUR OWN RISK,
FOR WHICH WE SHALL NOT BE LIABLE. IT SHALL BE YOUR OWN
RESPONSIBILITY TO ENSURE THAT SERVICES PROVIDED BY US MEET

- General Provisions:
- Notice: All notices served by iWhizz shall be provided via email to your account or as a
general notification on the Application. Any notice to be provided to the iWhizz should

- Entire Agreement: The Terms, along with the Privacy Policy, and any other guidelines
made applicable to the Application/Website/Services from time to time, constitute the
entire agreement between the iWhizz and you/the user with respect to your access to or
use of the Application, Website and the Services thereof.
- Assignment: You cannot assign or otherwise transfer your obligations under the Terms,
or any right granted hereunder to any third party. iWhizz's rights under the Terms are
freely transferable by iWhizz to any third parties without the requirement of seeking your
consent.
- Severability: If, for any reason, a court of competent jurisdiction finds any provision of
the Terms, or portion thereof, to be unenforceable, that provision shall be enforced to the
maximum extent permissible so as to give effect to the intent of the parties as reflected by
that provision, and the remainder of the Terms shall continue in full force and effect.
- Waiver: Any failure by iWhizz to enforce or exercise any provision of the Terms, or any
related right, shall not constitute a waiver by iWhizz of that provision or right.
- Relationship: You acknowledge that your participation on the Application, does not make
you an employee or agency or partnership or joint venture or franchise of the Company.
- iWhizz provides these Terms so that you are aware of the terms that apply to user’s use of
the Website/Application and Services. You acknowledge that, iWhizz has given you a
reasonable opportunity to review these Terms and that you have agreed to them.
- Feedback:
- Any feedback you provide with respect to the Application/Services shall be deemed to be
non-confidential. The Application/Services shall be free to use such information on an
unrestricted basis. Further, by submitting the feedback, you represent and warrant that (i)
your feedback does not contain confidential or proprietary information of you, the Minor
Student or of third parties; (ii) iWhizz is not under any obligation of confidentiality,
express or implied, with respect to the feedback; (iii) the Application/Services may have
something similar to the feedback already under consideration or in development; and
(iv) you are not entitled to any compensation or reimbursement of any kind from iWhizz
for the feedback under any circumstances, unless specified.
- Under no circumstances shall iWhizz be held responsible in any manner for any content
provided by other users even such content is offensive, hurtful or offensive. Please
exercise caution while accessing the Application/Website/Services.
- The Users are ultimately responsible for choosing and/or interacting with other Users on the Site and iWhizz is only a facilitator that shall not be held responsible or liable for the selection and/or interaction of the Users with other Users on the Site.

- Scraping, downloading (including bulk- downloading), replicating or otherwise extracting any information or data from iWhizz (by any process, whether automatic or manual) to offer any services which are similar to or may in any manner compete with the products or services of the iWhizz;

- Developing, using or attempting to use any automated program, scripts, robots, third party software or system or any similar or equivalent process (including spiders, robots, crawlers, browser plug-ins/extensions/add-ons, iframes on third party sites, mirroring, HTML parsers etc.) to access, navigate, search, copy, monitor, download, scrape, crawl or otherwise extract or modify in any manner, any data or content from iWhizz without explicit consent obtained in writing by approach us.
- Impersonating any other person or entity, or making any misrepresentation as to your employment by or affiliation with any person or entity;
- Forging headers or in any manner manipulating identifiers in order to disguise the origin of any user information;
- Stalking, threatening, or in any manner harassing any other User;
- Imposing an unreasonable or disproportionately large load on iWhizz’ infrastructure;
- Engaging in “framing,” “mirroring,” or otherwise simulating the appearance or function of iWhizz (or any part thereof) and providing deep links into iWhizz (or any part thereof) without prior permission of iWhizz;
- Spamming iWhizz/iWhizz or any other Users including by uploading, posting, emailing, SMS, transmitting or otherwise making available either directly or indirectly, any unsolicited bulk e-mail or unsolicited commercial e-mail.
- Hosting, modifying, uploading, posting, transmitting, publishing, or distributing any
material or information that:
- Violates any applicable local, provincial, state, national or international law, statute, ordinance, rule or regulation for the time being in force;
- Belongs to another person and to which you have no right;
- Infringes, breaches or otherwise contravenes the rights of the iWhizz or any third party, including any copyright, trademark, patent, rights of privacy or publicity or any other proprietary rights;
- Contains computer viruses, or other computer code, files or programs designed to disrupt, destroy or interfere with or limit the functioning of iWhizz, or any other computer system or resource;
- Is grossly harmful, harassing, invasive of another's privacy, hateful, disparaging, relating to or encouraging money laundering or gambling in any manner, any content which is or may potentially be perceived as being harmful, threatening, abusive, harassing, defamatory, libelous, blasphemous, vulgar, pornographic, paedophilic, obscene, or racially, ethnically, or otherwise unlawful in any manner whatsoever;
- Which constitutes or encourages conduct that would constitute a criminal offence, give rise to other liability, or otherwise violate applicable law;
- That deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
- That harms minors in any way;
- That threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting to any other nation.
- Notice: All notices served by iWhizz shall be provided via email to your account or as a general notification on the Application. Any notice to be provided to the iWhizz should be sent to info@iwhizz.in
- Entire Agreement: The Terms, along with the Privacy Policy, and any other guidelines made applicable to the Application/Website/Services from time to time, constitute the entire agreement between the iWhizz and you/the user with respect to your access to or use of the Application, Website and the Services thereof.
- Assignment: You cannot assign or otherwise transfer your obligations under the Terms, or any right granted hereunder to any third party. iWhizz's rights under the Terms are freely transferable by iWhizz to any third parties without the requirement of seeking your consent.
- Severability: If, for any reason, a court of competent jurisdiction finds any provision of the Terms, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of the parties as reflected by that provision, and the remainder of the Terms shall continue in full force and effect.
- Waiver: Any failure by iWhizz to enforce or exercise any provision of the Terms, or any related right, shall not constitute a waiver by iWhizz of that provision or right.
- Relationship: You acknowledge that your participation on the Application, does not make you an employee or agency or partnership or joint venture or franchise of the Company.
- iWhizz provides these Terms so that you are aware of the terms that apply to user’s use of the Website/Application and Services. You acknowledge that, iWhizz has given you a reasonable opportunity to review these Terms and that you have agreed to them.
- Any feedback you provide with respect to the Application/Services shall be deemed to be non-confidential. The Application/Services shall be free to use such information on an unrestricted basis. Further, by submitting the feedback, you represent and warrant that (i) your feedback does not contain confidential or proprietary information of you, the Minor Student or of third parties; (ii) iWhizz is not under any obligation of confidentiality, express or implied, with respect to the feedback; (iii) the Application/Services may have something similar to the feedback already under consideration or in development; and (iv) you are not entitled to any compensation or reimbursement of any kind from iWhizz for the feedback under any circumstances, unless specified.
- Under no circumstances shall iWhizz be held responsible in any manner for any content provided by other users even such content is offensive, hurtful or offensive. Please exercise caution while accessing the Application/Website/Services.
